{"id":97,"date":"2017-08-04T11:36:03","date_gmt":"2017-08-04T16:36:03","guid":{"rendered":"http:\/\/www.ssc.wisc.edu\/~drasmuss\/?page_id=97"},"modified":"2020-07-21T10:06:21","modified_gmt":"2020-07-21T15:06:21","slug":"sexual-harassment-mandatory-sexual-assault-reporting-and-consensual-relationships","status":"publish","type":"page","link":"https:\/\/www.ssc.wisc.edu\/soc\/instructor-handbook\/sexual-harassment-mandatory-sexual-assault-reporting-and-consensual-relationships\/","title":{"rendered":"Sexual Harassment, Mandatory Sexual Assault Reporting, and Consensual Relationships"},"content":{"rendered":"<h3>What is Sexual Harassment?<\/h3>\n<p>Unwelcome sexual advances, requests for sexual favors, and verbal of physical conduct of a sexual nature constitute sexual harassment when:<\/p>\n<ul>\n<li>Submission to such conduct is a condition of employment, academic progress, or participation in a university program; or<\/li>\n<li>Submission to or rejection of such conduct influences employment, academic or university program decisions; or<\/li>\n<li>The conduct interferes with an employee\u2019s work of a student\u2019s academic career, or creates an intimidating, hostile or offensive work, learning, or program environment.<\/li>\n<\/ul>\n<p>Tangible Action or Quid Pro Quo (This for That) Sexual Harassment and Hostile Environment Sexual Harassment are both <a href=\"https:\/\/employeedisabilities.wisc.edu\/wp-content\/uploads\/sites\/343\/2017\/09\/Sex-Harass-Bro17_proof2.pdf\">illegal and unacceptable<\/a>.<\/p>\n<p><strong>Tangible Action or Quid Pro Quo (This for That) Sexual Harassment<\/strong> occurs when employment or academic decisions resulting in a significant change in status are based on an employee\u2019s or student\u2019s submission to or rejection of unwelcome verbal or physical sexual conduct. Examples include:<\/p>\n<ul>\n<li>requiring sexual favors in exchange for hiring, a promotion, a raise, or a grade<\/li>\n<li>disciplining, demoting, or firing an employee because he or she ends a consensual relationship<\/li>\n<li>refusing to write recommendations for a graduate student because the student refuses sexual advances<\/li>\n<li>changing work or academic assignments because an employee or student refuses invitations for a date or other private, social meetings<\/li>\n<\/ul>\n<p><strong>Hostile Environment Sexual Harassment<\/strong> occurs when verbal, non-verbal, and\/or physical conduct is:<\/p>\n<ul>\n<li>sexual and\/or based on gender,<\/li>\n<li>unwelcome, and<\/li>\n<li>sufficiently severe and pervasive to interfere with a person\u2019s work\/learning\/program performance or to create a hostile, intimidating, or offensive environment<\/li>\n<\/ul>\n<p><a href=\"https:\/\/compliance.wisc.edu\/titleix\/employee-information\">Click here<\/a> for more information on sexual harassment (key points; defining and addressing; what to do) and the <a href=\"https:\/\/compliance.wisc.edu\/wp-content\/uploads\/sites\/102\/2018\/01\/UW-Madison-Policy-on-Sexual-Harassment-And-Sexual-Violence-January-2018.pdf\">UW-Madison Policy<\/a> on Sexual Harassment and Sexual Violence.<\/p>\n<p>&nbsp;<\/p>\n<h3>Mandatory sexual assault reporting<\/h3>\n<p>All faculty and staff members at the University of Wisconsin-Madison share the responsibility to create safe learning and work environments and a positive campus climate. This memorandum addresses federal and state laws and a Wisconsin Executive Order that establish reporting responsibilities for all faculty and staff.
